TERMS AND CONDITIONS OF HAUL-OUT.

1. GENERAL

This document details the agreement between the Boat Owner and the SPCC Committee who is represented by the haul-out Team Leader or their delegated representative on the day the vessel is slipped (i.e hauled out or re-launched or moved on hard standing). By signing this agreement the Boat Owner agrees to abide by the conditions and terms stated below.

Failure of the owner to provide this signed agreement to the haul out Team Leader prior to haul out will result in refusal to haul.

2. HAUL-OUT CONDITIONS

All work associated with slipping the vessel shall be at the discretion of the haul out Team Leader. The haul out Team Leader shall be a club member, approved by the SPCC Committee Member I/C Haul outs and on the current haul out roster.
The Team Leader reserves the right to refuse haulage if he/she considers any aspect of the operation poses undue risk to property or individuals.
In any given year the haul-out season shall be from the 1st June to the 18th December inclusive.
The Boat Owner agrees to abide by any environmental management requirements laid down by the club, especially when carrying out any maintenance or repair work. The current specific requirements relating to haul out, hard standing and re-launch operations are specifically:
No boat will be hauled unless the hull is free of marine growth.
No removal from the member’s boat of antifouling or other paint by either water blasting or wet sanding.
Any paint or other material that is removed from the member’s boat must be collected and disposed of so as not to cause damage to either the land or marine environment.
If a haul out is being requested outside the haul out window the boat owner must get approval from the haul-out SPCC Committee member, and supply to him the completed original of the Hardstand agreement. The names of each haul out crew member must be written on the form. The boat owner may act as Team Leader of the haul out team provided he/she has had appropriate training and experience and is approved by the SPCC Committee Member I/C haul outs. This is a mandatory requirement.

3. BREACHES OF AGREEMENT

Failure to meet either of the following conditions constitutes a breech of the agreement and shall result in notification to the Boat owner followed by the vessel being re-launched or other designated action within 14 calendar days of that notification.

Late payment or non-payment of fees.

The Boat owner becoming a non-financial member.

4. COSTS, RESPONSIBILITIES AND REMEDIES

All costs associated with haul out, hard standing and re-launching and the provision of a safe and secure mooring shall be borne by the owner. A pre-requisite of haul out, hard standing and re-launch is that the vessel shall be in such a condition as to be adequately safe and secure whilst on land or afloat.
The haul out Team Leader shall make the initial decision as to whether a vessel is safe to haul out, remain on hard standing or re-launch.
In the case of dispute the SPCC Committee shall make the final assessment of the condition of the vessel. The Committees decision is final as to whether the owner’s boat is acceptable for haul out, hard standing or re-launch.
Vessels that are deemed unsuitable shall be re-located to the owners address or some other suitable place or sold to defray expenses. Such funds that may remain after the recovery of expenses will be returned to the owner.

5. EXEMPTIONS

The SPCC Committee reserves the right to amend this agreement, as circumstances require.
From time to time the SPCC Committee may waive certain requirements of this agreement where extraordinary circumstances prevail. Such a waiver will require the owner to apply to the SPCC Committee in writing. The letter should state the reasons for requesting a waiver and the period for which the waiver is requested.
Approval can only be considered valid if the SPCC Committee gives it in writing. The details of the approval shall be recorded in the relevant club meeting minutes
